Congress set to form sunset commission to review federal programs
From time to time, we hear about plans to get rid certain federal agencies, such as OSHA and the Corporation for Public Broadcasting. Last month, however, these conversations became more than just ideas floated about; House majority leader John Boehner made a deal with the Republican Study Committee in which the RSC would vote for Bush's budget resolution, and the House would form a sunset commission to review federal agencies. The purpose of the review is to overhaul, consolidate, or eliminate a number of federal agencies. The commission will consist of eight members, to be appointed by George W. Bush or his allies in Congress. They will review federal programs every ten years.
On its face, the commission appears to be a useful entity for cutting waste in government, but given the Bush administration's history, it is reasonable to expect it to function as a tool for the removal of government regulation. There is nothing in the deal, for example, that would prohibit lobbyists from being appointed to the commission.
Bush's long-time friend, Clay Johnson, is the architect of the sunset commission. When Bush was governor of Texas, Johnson got rid of the state environmental protection agency and replaced its members with industry representatives. Critics of the plan are justifiably calling the commission a dream come true for the planners of the Reagan government. Once the commission is formed, officials of various government programs will have to "plead their case" in order to remain operative.
There are currently two bills that would advance the formation of the sunset commission. One, the Brady Bill, exempts the commission from various sunshine laws, and the Tiehrt gives the commission subpoena power.

Dear Government, why even bother forming this sunset commission to do your dirty work when you know damn well that you can get away with murder without raising hardly any eyebrows...
After EPA administrator Christie Whitman put the EPA ombudsman under the supervision of the department's Inspector General (in other fed. agencies he or she reports directly to the highest levels of the agency), a report by the General Accounting Office (auditing arm of Congress) articulated how under the new structure the EPA ombudsman lacks the authority to decide what complaints warrant investigation.
The then current EPA ombudsman, Robert Martin, clashed repeatedly with Whitman and her predecessor in the Clinton administration (evidently Hilary was too busy to take notice...???) over environmental cleanup projects and had alleged that Whitman had allowed certain financial concerns of her husband's to influence her decisions at EPA.
After winning supporters in communities because of his advocacy for a more thorough cleanup of a battery recycling facility in Throop, Pa., and getting answers to resident's questions about the cleanup of the Shattuck Chemical Co. Superfund Site in Denver. Martin went a step too far when he criticized the cleanup of 'ground zero."
In fact, Whitman's unilaterial decision to undermine the ombudsman's office was illegal because she failed to publish notice and no comment period was provided (as required by Title 5 U.S.C. Sec. 553), thus, actually, her malicious move was invalid...
The Stauffer Superfund Site is located in Tarpon Springs, Fl., in the midst of a residential community and across the street from an elementary school. Though it closed down in 1981, the company left behind approx. 500,000 tons of chemical and radiological contaminants, buried in drums, poured into unlined pits, and sometimes directly onto the ground. With the approval of EPA Region 4 officials, the company proposed containing all the mess onsite, rather than removing it. And they made this decision without completing the necessary geophysical or hydrogeological studies. Then, shortly before a Town Meeting that had been scheduled to review progress being made, Martin and his chief investigator were informed that their Request for Funding Approval had been denied, and that they were to apply their resources elsewhere... And soon after this, the chief investigator was denied permission to do any more work for the ombudsman, and Martin was informed that he didn't have the right or authority to control his own staff... Martin, a member of the Makak Indian tribe on the Olympic Peninsula, says that the curtain fully came down on him after he raised questions about Whitman's financial ties to a firm that provided insurance around ground zero...
In Aug. '05, the top official at the U.S. Army Corps of Engineers in charge of awarding government contracts for the reconstruction of Iraq was demoted. Previously she'd received stellar evaluations from superiors--until she voiced concerns about secret, no-bid contracts awarded to Kellogg, Brown & Root, a subsidary of Halliburton. After telling congress that one deal was the most blatant and improper conduct that she'd ever witnessed, she was reassigned...
So, you know, why bother reshuffling when you're using a marked deck...

Sunset commissions are not necessary and patently unconstitutional due to the separation of powers. For the President to be able to appoint company owners or lobbyists to this commission instead of elected officials is obsurd. The sunset commission would be able to recommend the axe to any federal program, grant, or agency and take the debate away from our lawmakers. This would only allow them a straight up and down vote. It waistes resources by forcing these agencies and programs to justify their continuted existence, even forcing proven programs to expend valuable time and funds to this meaningless inquiry.
