Don't. Cross. Dick. Cheney.

Associate Deputy Attorney General Patrick Philbin didn't play by Dick's rules. He was present at John Ashcroft's hospital bed the night of March 10, 2004, as Andy Card and then-White House counsel Alberto Gonzales tried to strong-arm the woozy Ashcroft into reauthorizing the controversial warantless wiretapping program. But Philbin advised Ashcroft not to reauthorize it. Eventually, facing the threat of 8 politicized resignations, Bush and his band backed down and modified the plan to address concerns shared by Philbin, Ashcroft, and the Acting A.G., James Comey.

After Gonzales (whose initials are A.G.—isn't that nifty?) assumed the post of Attorney General, he sought to promote Philbin to Deputy Attorney General. James Comey indicated today in written Senate testimony that word came down from Cheney's office that the dark lord would oppose the promotion. "I understood that someone at the White House communicated to Attorney General [Alberto] Gonzales that the vice president would oppose the appointment if the attorney general pursued the matter," Comey wrote. "The attorney general chose not to pursue it."

At first blush, this sounds like standard tit-for-tat politics. But one of the Justice department's main functions is to advise the White House on the legality of its proposed policies. If telling them that a policy would violate the Constitution (even when bringing it into line wouldn't mean throwing it out entirely) means being blacklisted, that sends a clear signal that the White House has no interest in abiding by the terms of the 200-plus-year-old document. Not that that should come as news to anybody.

This is just unAmurikan! The VP knows what's best for the country. He don't need some musty old piece of paper to tell him what we need to protect ourselves from turrists. I hope Cheney/Bush declare themselves leaders for life. They'll pertect us. GOOOOOO CHENEY/BUSH!

Hakori, I can only assume you are attempting to be humerous; especially due to what appears to be deliberate mispellings. Anyway, there are quite a few brain dead people that really believe that these guys want what's good for the US I am not one to argue with that being that some may believe what's good for them is in turn good for the country. However, I do seriously doubt that Bush or Cheney love the Lord. They have a religion of convenience. BTW, I don't recall ever seeing Bush attend church, other than a funeral. Then again, he does have a personal audience with Lord. I wonder what advice He gave Bush during Katrina, Abu Ghraib, or when another American soldier or Iraqi citizen dies. I know the first words I spoke when I learned of these events were 'Oh My God'. BTW, I'm NOT religious and I don't attend or am actively involved in ANY church.

According to his Congressional testimony, James Comey came to John Ashcroft's bedside and warned him that Andy Card and Alberto Gonzales were on their way to the hospital to pressure him into signing authorization that would approve of illegal wiretaps and that he was present when they arrived. He testifyed that Ashcroft refused to sign the document and told them that in any case he wasn't the A.G., pointing to Comey (acting A.G.) and letting them know they were asking the wrong person. I believe Comey indicated that Ashcroft's wife was present but didn't mention anything about Philbin being there.

So, how do you conclude that Philbin was present and the one who advised Ashcroft not to sign the document?

Don't get me wrong; I don't doubt that the dark lord would use his influence in such a manner, I just question whether the reason was this incident.

If both Philbin & Comey were present at the hospital, the post would have been more accurate to say that, and more powerful if it had stated clearly that both Philbin & Comey were there in support of John Ashcroft.

The article to which I linked said Philbin was there--and Comey as well.

Perhaps its time to Super Size Congress! So much money pours from taxpayers into Government vaults that its time to see the system in terms of how it actually operates. Given the costs of campaigning, it makes sense to enhance our democracy by increasing the number of senators and congress folks. State populations aren't what they were a couple hundred years ago == not even close. So, how would our energy problems really be dealt with if there were real accountability? It seems that the courts (Blueberry Hill) took the worry out of being accountable from the legislature and transfered that lack of accountability to the agency of the government.
Oligarchy or rule of the few is what this government is about, the words say of the People but what do the deeds actually say? So what and you don't matter! Let's compare.
