Bush's Last-Minute Gift to Crappy Nursing Homes

That Bush-Cheney legacy is going to be a mean one for years. And there's likely to de a drip-drip-drip disclosure of all the damage done. For instance, on Tuesday there was news that the Bush administration screwed nursing homes residents. Bloomberg reports:

The Bush administration shut off a source of information last fall about abuse and neglect in long- term care facilities that people suing nursing homes consider crucial to their cases.

The change that affects the $144 billion nursing-home industry occurred with no public notice or attention, perhaps because of the array of last-minute rules that President George W. Bush’s appointees rushed out before leaving Washington last month.

“This is pretty stunning,” said Mark Kosieradzki, a plaintiff attorney in Plymouth, Minnesota. “Nobody was told. It was just done.”

The rule designates state inspectors and Medicare and Medicaid contractors as federal employees, a group usually shielded from providing evidence for either side in private litigation.

The restrictions affect about 16,000 nursing facilities in the U.S. and 3 million residents. The practical effect is to force litigants to go to greater lengths, including seeking court orders, to get inspection reports or depositions for cases they are pursuing or defending.

Wonder who asked for this rule change? Could it have been...the nursing home industry? This was truly a harsh move, making it harder for abused nursing home residents to gather information on the institutions in which they live. Big hat tip to Bloomberg for a fine piece of investigative reporting that uncovered a telling example of the Bush administration's compassionate conservatism.

When will Americans Wake Up

Another Republican bomb against the elderly in our country. Neither Bush nor the GOP have ever done nor cared about seniors, for that matter, for any hardworking, taxpaying American. They put politics OVER people, rebuild other countries, give huge tax breaks to Wall Street and corporations and disregard poor and middle America. A nursing home is too good for the likes of a presidential criminal, send the outlaw to Guantanamo Bay and take away his right to a trial.

I am one the countless

I am one the countless employees of one of those 14,000 nursing homes in our county, and my question to all of you that oppose this ruling is " Are you willing to quit your jobs, do without the luxuries of your current situation, and provide 24 hr a day care for the elderly in your community that have no one to do that for them?" Nursing homes have been regulated to the point that paperwork is more important than the care provided, all to provide guilt ridden families substantial information to pursue countless, money wasting, unfounded litigation against a facility that they would constantly complain about, but refuse to remove their relative from. And how about the residents that continue to be abused and neglected by the very families that placed them in the nursing home to begin with. Put your money where your mouth is. Give us the reimbursement that we need to provide quality care to those thousands of souls that have no one else to provide that care for them. And I hope for your sakes, there are still homes available when you need one. Or on second thought, maybe not. You don't deserve it.

Are you kidding?

If your job is too difficult, find another one. This is about ABUSE. Get it? This is about shielding perpetrators of abuse. Get it? I agree more families should take care of their parents and that some inquiries might actually be a bit frivolous but you sound as if you'd have the patients suffer just to keep the status quo. That's utterly asinine. You should find another occupation if your patients are numero uno on your priority list, pal. For real.
