Chamber Sues the Yes Men
The Chamber of Commerce is suing the Yes Men over the parody press conference the group pulled off last week.
The Chamber has filed a civil complaint in the US District Court of Washington, DC, accusing Yes Men Jacques Servin and Igor Vamos (also known as Andy Bichlbaum and Mike Bonanno, respectively) of trademark infringement, unfair competition and false advertising. The Chamber's suit also lists several members of the DC-based activist group the Avaaz Action Factory as co-defendants. The conduct of those who organized the event was "destructive of public discourse," the Chamber argues.
As the Yes Men have a new film in theaters currently, The Yes Men Fix the World, the Chamber also alleges that the prank was part of a "comprehensive scheme to promote their movie by wrongdoing against the plaintiff"—rather than an event meant to call attention to the organization's views on climate change.
"The defendants are not merry pranksters tweaking the establishment," said the Chamber in a press release issued with the suit. "Instead, they deliberately broke the law in order to further commercial interest in their books, movies, and other merchandise."
The Chamber has already issued a complaint regarding the parody website that the Yes Men created for the event.
Despite the fact that the Yes Men have pulled off similar stunts spoofing Exxon, Dow Chemical, Halliburton, George W. Bush, and the World Trade Organization, among powerful entities, they've never actually gone to court over them, according to the group. The Chamber appears to be taking the hoax a bit more seriously than previous targets of their humor.

The Chamber of Commerce, just like their right wing counterparts, are cry babies and reality deniers. They are trying to use the premise that the YeS Men are motivated by the same thing the Chamber is, profit.... either they are unable to comprehend any activity not profit based or they are coldly aware that their own motivations go little beyhond themselves and are trying and end run...... Whatever it is, I salute the Yes Men and gracefully encourage the Chamber to eat shit and die....

Actually, no. It's not a premise. Conservatives have so changed the court system in this country, that the only way the courts look at civil cases is based around a loss of profit, or of value, in relation to a business.
By framing it as business activity, rather then a free-speech activity, the Chamber hopes to convince a court that it's image was harmed by the parody put out by the Yes Men.
I'm guessing that all members of the Federalist Society now on the federal bench will tend to see things the Chamber's way.

Thing is, The Onion also picks on people to make a buck, so again we're back to the parody defense.
Yeah, the CoC's going to try and make this expensive and scary for the Yes Men and their allies -- but from what I've heard of the Yes Men, they will consider it worth the cost if they can publicize the CoC's nefarious stance on climate change.
Civil Disobedience
I sincerely hope any court hearing this case has read Walden--or other social philosophers--regarding the usefulness of civil disobedience.
That is really what the Yes Men are doing, being civilly disobedient to draw attention to the practices of large companies and actions of the powerful.
I think the Yes Men's actions are commendable and should be encouraged--if they are found guilty in this it will send them underground and I can see a number of other groups getting quite upset about that.
On the other hand if they go underground their pranks could become even more intensely potent.

So, let me get this logic straight. The CoC is accusing the Yes Men of upstaging the CoC not to make a point, but to make a buck and promote their movies and books, and the CoC answer is to give them more of a forum by suing them. It's a bit scary that American business relies on these bone heads to speak for them.

This suit will only raise awareness that despite its confusing name, the Chamber of Commerce is not part of the government. (House Chamber, Senate Chamber... and then there's the sound-alike, the Chamber of Commerce, with no relation.) It is a private den of businessmen. Businessmen who don't understand that parody is protected speech.

The reporters did not "accidently" report the fake press release. They mistakenly reported it as fact - big difference. The major point is why any reporter would not check out the story prior to publishing or announcing it. Would they announce that the Pope had just become a Muslim if a press release stating that came across their desks?

Poor US Chamber of Neo-Cons er Conservatives er Commerce
Remember the old saying, "F them if they can't take a joke." I am getting old, I can remember when conservatives at least were part of the discussion on any topic. Now the conservatives, such as the US Chamber, just want to push their ultra right adjenda and drown out anybody who disagrees. They are the Tea Party in suits.

If the CoC were astute enough to understand their own mission, they'd applaud the moment that free speech takes on a profit motive.
COC May Draw Fire When Forced to Clarify Their Dubious Position
The Chamber of Commerce does not seem to realize that engaging the Yes Men in a lawsuit will only bring further (perhaps widespread/ national) exposure to their position as a lobbying organization that seeks to undermine what is best for the health of consumers.
If consumers are persuaded to investigate what companies stand behind the COC's ridiculous climate change denials, it may reflect poorly on those companies' business standards and practices, which may in turn result in a loss of revenue by consumers.

I wonder if the chamber of commerce has any idea of how idiotic this lawsuit is.
They are giving the Yes Men 's attorneys a chance to get representative from the chamber on the stand to testify as to what exactly the chamber's stand on climate change is in order to show that the Yes Men "defamed" them.
This should be very entertaining.
