Could Those Lost E-mails Cause Fitzgerald to Re-open Leak Case?

Whoopsie! We lost 5 million e-mails! Thus spoke the White House, as Dan blogged earlier today. And a particularly huge number seem to belong to a certain Mr. Rove. All of these e-mails were exchanged during the period of time U.S. Attorney Patrick Fitzgerald investigated in connection with the leak of Valerie Plame Wilson's identity. Fitzgerald had been led to believe that he had a full accounting of official communications during the period in question. Citizens for Responsibility and Ethics in Washington—a watchdog group that is also representing Joe and Valerie Wilson in their civil suit against administration officials—is now calling on Fitzgerald to re-open his investigation, given that the source of the leak may well have covered his electronic tracks. This is getting fun, isn't it?

The day prior CREW released its report, "Without a Trace," which documents the extent of the email problem. CREW maintains an archives and an open community document review database of FOIA-gained documents which can use volunteers to help in annotation. CREW's publication of the page emails, you may remember, precipitated the resignation of Mark Foley. Thus far Karl Rove has seemed immune to any repercussions from the exposure of his actions. Maybe this will finally change his luck. It couldn't happen to a nicer guy. Here's hoping he develops a case of friggatriskaidekaphobia(fear of Friday 13th, the day when Crew wrote Fitzgerald.)

And speaking of bad luck,environmentalists and progressives in general may be mulling over their prospects at the EPA today and wondering if Bush is up to more shenanigans with regards to nominations Alex A. Beehler and William Ludwig Wehrum, Jr.

Well as great as it would be, you can forget hoping Fitzgerald will reopen the case on this evidence. If you will go back to the Libbey case and read the reports, you will note a letter from Fitzgerald to the defense attorney, acknowledging that he was aware of missing e-mails. I would think that the only real hope we would have to nail Rove and his minions would be a special prosecutor, but do we actually have much hope that we will see that? I would like to see many of the posters on both sides of the aisle, to actually go and read the Constitution, the part that covers the power of the executive and legislative branch in the event of war is quite interesting. Perhaps the POTUS and his staff should read it?
